KiwKiw is a multi-tenant AI-powered messaging automation platform that enables businesses to:

• Connect Meta (Facebook Messenger) Pages via OAuth
• Automate message responses
• Manage conversations
• Integrate AI-generated replies
• Store credentials and related configuration

KiwKiw does not own or control Facebook, Meta Platforms, Google, or any third-party service.

3. Eligibility

You must:

• Be at least 18 years old
• Have authority to act on behalf of the business connecting a Page
• Comply with all applicable laws

4. Account Registration

To use KiwKiw, you must:

• Create an account
• Provide accurate information
• Maintain confidentiality of login credentials

You are responsible for all activity under your account.

5. Facebook & Third-Party Integrations

By connecting your Facebook Page, you:

• Authorize KiwKiw to access permitted Page data
• Confirm you have administrative rights to the Page
• Accept that platform functionality depends on Meta’s APIs

KiwKiw is not responsible for:

• API outages
• Platform changes
• Permission revocation
• Third-party service disruptions

6. AI-Generated Content Disclaimer

KiwKiw may generate automated responses using AI systems.

You acknowledge that:

• AI responses are automated
• Content may not always be accurate
• You are responsible for reviewing and configuring chatbot behavior
• KiwKiw does not guarantee correctness, legality, or appropriateness of AI output

You assume responsibility for all automated communications sent through your connected Pages.

7. Acceptable Use

You agree not to use KiwKiw to:

• Violate laws or regulations
• Send spam or abusive content
• Engage in fraud or deception
• Infringe intellectual property
• Misrepresent identity
• Circumvent platform safeguards

We reserve the right to suspend or terminate accounts violating these terms.

8. Subscription & Payments

If applicable:

• Subscription plans may be offered
• Fees are non-refundable unless required by law
• Failure to pay may result in suspension

Pricing and features may change with notice.

9. Data & Privacy

Use of the Service is governed by our Privacy Policy.

KiwKiw acts:

• As Data Controller for account information
• As Data Processor for client conversation data

10. Service Availability

We aim to provide reliable service but do not guarantee:

• Uninterrupted access
• Error-free operation
• Continuous availability

Maintenance or outages may occur.

11. Limitation of Liability

To the maximum extent permitted by law:

KiwKiw shall not be liable for:

• Indirect or consequential damages
• Loss of revenue or business
• Content generated by AI
• Third-party platform failures

Our total liability shall not exceed the amount paid for the Service in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless KiwKiw from claims arising from:

• Your misuse of the Service
• Content sent via your connected Page
• Violations of applicable laws
• Breach of these Terms

13. Termination

We may suspend or terminate accounts if:

• Terms are violated
• Required by law
• Necessary for security reasons

You may terminate your account at any time.

14. Changes to Terms

We may update these Terms periodically.

Continued use of the Service after changes constitutes acceptance.

15. Governing Law

These Terms shall be governed by applicable laws without regard to conflict-of-law principles.
